California Senate Bill 478 mandates that all costs are clearly disclosed to customers. By banning hidden fees, this legislation aims to eliminate deceptive practices to foster greater trust and transparency between merchants and their customers.
How You Can Stay Compliant
Here are some of the compliance measures you can take…
- Clear Disclosure: It is imperative that merchants transparently disclose any surcharges or dual pricing policies and clearly indicate the surcharge amount as a percentage of the transaction at the store entrance, point of sale, and on receipts. This disclosure must clarify that the surcharge covers credit card processing fees.
- Surcharge Limit: A surcharge added to a credit card transaction cannot exceed the merchant’s payment processing cost. Thus, merchants must make sure that their surcharge reflects their actual processing costs and does not generate additional revenue.
- No Surcharges on Debit Cards: California law prohibits surcharges on debit card transactions. Merchants must ensure that any surcharge policies apply only to credit card transactions.
- Educate Your Staff: All staff members should understand and be able to adequately explain the surcharge or dual pricing policy to guarantee that it is applied correctly and consistently.
- Documents and Record Keeping:
